Liability Waiver

This documented will be presented to you to be signed prior to onboarding.

1. Acknowledgment of Risk

I, the undersigned, acknowledge that participating in a sailboat tour with SeaScape involves inherent risks, including but not limited to, the risk of personal injury, property damage, or death. I voluntarily choose to participate in this activity, fully aware of these risks.

2. Assumption of Risk

I accept and assume all risks associated with the sailboat tour, including but not limited to, weather conditions, sea conditions, equipment failure, and the actions or omissions of the crew or other participants.

3. Waiver and Release of Liability

In consideration of being allowed to participate in the sailboat tour, I hereby waive, release, and discharge SeaScape, its owners, employees, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in the sailboat tour, including any claims for personal injury, property damage, or death, whether caused by negligence or otherwise.

4. Indemnification

I agree to indemnify, defend, and hold harmless SeaScape, its owners, employees, agents, and representatives from and against any and all losses, liabilities, claims, damages, costs, and expenses (including attorneys’ fees) arising out of or in connection with my participation in the sailboat tour.

5. Medical Fitness and Health

I certify that I am in good health and physical condition and do not have any medical conditions that would prevent me from safely participating in the sailboat tour. I have disclosed any relevant medical information to SeaScape and understand that failing to do so may result in increased risk.

6. Emergency Medical Treatment

In the event of an emergency, I consent to receive necessary medical treatment and agree that I am responsible for any costs incurred as a result of such treatment.

7. Governing Law

This Liability Waiver shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with this waiver shall be subject to the exclusive jurisdiction of the courts of Ireland.

8. Severability

If any provision of this Liability Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Entire Agreement

This Liability Waiver constitutes the entire agreement between SeaScape and me regarding the subject matter herein and supersedes any prior or contemporaneous agreements, understandings, or representations.
